These Terms and Conditions for the Provision of Services by Electronic Means have been prepared on
the basis of Article 8 of the Act of 18 July 2002 on the Provision of Services by Electronic Means
(Journal of Laws of 2002, No. 144, item 1204, as amended) and constitute an integral part of the sales
agreement for the https://gralik.pl of Ebooks, Books and Audiobooks offered by the Online Store. The
Terms and Conditions are made available free of charge via the Online Shop https://gralik.pl, the
above provides the opportunity to read its content before concluding the contract. The Online Shop is

GLOSSARY OF TERMS:
Online Shop – An online shop available under the Internet domain https://gralik.pl. Customer – a
natural person with full legal capacity, a legal person or an organizational unit without legal
personality, but with legal capacity, using the Online Shop https://gralik.pl, including in particular
making purchases. Consumer – a customer who is a natural person, making purchases in the Online
Shop https://gralik.pl to the extent not directly related to his business or professional activity (in
accordance with Article 221 of the Act of 23 April 1964, the Civil Code (Journal of Laws 1964.16.93)
Payment Executor – an entity external to the Online Shop https://gralik.pl an intermediary in the
execution of payments by bank transfer or payment card. Settlements of card and e-transfer
transactions are carried out via Dotpay.pl Electronic transfer and payment by debit/credit card –
payment made by the Client from an on-line bank account or card payment/credit card, via on-line
payment systems made available by the Online Shop. Payment made before the order is processed
(prepayment); Ebooks – the so-called e-books, i.e. books in electronic version. Ebooks are sold in the
form of digital PDF, MOBI, EPUB files. PDF – (Portable Document Format) file format of the same
name developed by Adobe Systems. EPUB – (Electronic Publication) – an open standard based on the
XML language used to publish electronic books. MOBI – an electronic recording format, designed
primarily for Kindle e-readers. A book – a graphic document (characters, other symbols, images), with
a certain number of pages, containing a fixed human thought, a compact publication, of a permanent
nature.
Audiobooks – a voice-over recording containing readings of the text of e-book publications, books, in
the form of MP3 digital files MP3 – Digital Audio Compression Customer Support – the Customer
Service Office available at the e-mail address on the main page of the Online https://gralik.pl Online
Store and via the contact form via the Internet at https://gralik.pl/kontakt/
§1 General provisions
1. These Terms and Conditions define the rules for using the https://gralik.pl Online Store, placing
orders for Books, Ebooks and Audiobooks available in the https://gralik.pl Online Store, delivering the
ordered Books, Ebook and Audiobook files to the Customer, paying the sale price for Books, Ebooks
and Audiobooks by the Customer, the Customer’s rights to cancel the order and withdraw from the
contract, and the rules for subming and considering complaints.
2. In order to use the https://gralik.pl Online Shop and place orders for Books, Ebooks and
Audiobooks, it is necessary to: a) access to the Internet and a web browser of the following type: –
Internet Explorer 10.0 or higher – Google Chrome 48.0 or higher, – Mozilla Firefox 45.0 or higher. b)
an active e-mail account.
3. The Customer is entitled and obliged to use the Online Shop https://gralik.pl in accordance with its
intended purpose.
4. The Client is obliged to refrain from any activity that could affect the proper functioning of the
Online Shop https://gralik.pl, including in particular any interference with the content of the Online
Shop https://gralik.pl or its technical elements, including the provision of illegal content. It is
forbidden to use https://gralik.pl in the Online Shop for purposes other than its intended use,
including in particular sending spam, conducting any commercial, advertising, promotional activities
on the https://gralik.pl websites of the Online Shop, etc.
5. The Online Shop https://gralik.pl to the fullest extent permitted by law, shall not be liable for any
disruptions, including interruptions, in the functioning of the Online Shop https://gralik.pl caused by
force majeure, unauthorised actions of third parties or incompatibility of the Online Shop
https://gralik.pl with the Customer’s technical infrastructure.
6. Browsing and purchasing Books, Ebooks and Audiobooks in the https://gralik.pl Online Store does
not require registration.
7. Settlements of transactions by electronic transfer and debit/credit card are carried out via on-line
payment systems made available by the Online Shop
§ 2 Registration
1. In order to register in the Online Shop, https://gralik.pl must fill in the fields by providing your
name and surname or nickname (pseudonym), e-mail address, correspondence address and
telephone number, accept the terms and conditions of the Online Shop https://gralik.pl and consent
to the processing of personal data to the extent necessary to establish, shape the content, change,
terminate and properly perform services provided electronically and to process the Customer’s
orders.
2. Registration in the https://gralik.pl Online Shop, as well as the use of the functionalities of the
Online Shop https://gralik.pl the Online https://gralik.pl, are free of charge.
§ 3 Product information
1. Information about the products available in the assortment of the Online Shop https://gralik.pl
constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
2. The prices of the products indicated on the websites in the Online Shop https://gralik.pl:
a) include VAT and are quoted in Polish zloty;
b) do not include delivery costs (applies to the Book product) (you need to add – but not here –
shipping options by inpost, post, DHL, or anything with some flat fee of 11.50 in Polish added to the
amount of the publication/product Book. I don’t remember if the Store supports Poland only, or
World/Europe) To be agreed with the developer.
(c) relate to a single unit of the product.
3. The Online Shop https://gralik.pl reserves the right to make changes in the prices of products on an
ongoing basis and to carry out and cancel all kinds of promotional campaigns and sales. The
entitlement referred to in the previous sentence does not affect orders placed before the effective
date of the change in price, terms and conditions of promotional campaigns or sales.
4. Promotions in the Online Shop are https://gralik.pl not cumulative, unless the terms and conditions
of a given promotion provide otherwise.
§ 4 Terms and conditions of order execution
1. The Customer may place orders for products available in the Online Shop https://gralik.pl 5 (five)
working days from Monday to Friday, excluding public holidays from 10:00 a.m. to 5:00 p.m.
2. In order to place an order, you need to:
a) select the Ebook that is the subject of the order;
b) select the Book that is the subject of the order;
c) select the Audiobook that is the subject of the order d) choose a payment method; e) pay for the
order in one of the online payment methods made available by the Online Store.
3. Placing an order by the Customer means placing an offer in the Online https://gralik.pl Shop to
conclude a contract for the sale (purchase) of the ordered Book, Ebook or Audiobook.
4. Aer placing an order and recognizing the payment through the on-line payment system made
available by the Online Store, the ordered Ebook or Audiobook will be sent to the indicated
correspondence or e-mail address of the Customer.
5. In the event that it is not possible to complete the order, the Online Shop may https://gralik.pl offer
the Customer to cancel the entire order (if the Customer chooses this option, the Online Shop will
https://gralik.pl be exempt from the obligation to execute the order);
6. In the event that the Customer does not make a decision in the situation referred to in paragraph 5
of this paragraph (including in the event of inability to contact the Customer for reasons not
attributable to the Online Shop https://gralik.pl), the Online Shop may https://gralik.pl cancel the
order in its entirety, within 7 days from the date of providing the Customer with information about
the inability to complete the order.
7. In the event of cancellation of the order, the Online Shop will https://gralik.pl refund the amount
paid to the Customer (or part thereof in the case of partial execution of the order (and if the
Customer orders the Book and the Ebook, then if the Ebook is not fulfilled, the amount for the Ebook
will be refunded – probably this will not happen at all because the Customer enters one amount on
the transfer)) in accordance with the generally applicable law.
8. In the event that the Customer provides an incorrect or inaccurate correspondence address or email
address, the Online Shop shall https://gralik.pl not be liable for non-delivery or delay in delivery
of the subject of the order to the fullest extent permitted by law.
§ 5 Rules for the use of Books, Ebooks and Audiobooks
1. All Books, Ebooks and Audiobooks offered by the https://gralik.pl Online Store are protected by the
Act of 4 February 1994 on copyright and related rights and may be used only on the terms set out in
these Terms and Conditions and in the license.
2. The Client has the right to use the Books, Ebooks and Audiobooks only for their own use in
accordance with generally applicable laws.
3. In particular, the Client is not entitled to:
a) distribute Books, Ebooks and Audiobooks or their works in whole or in part;
b) record or reproduce Books, Ebooks and Audiobooks for the purpose of disseminating them; c)
commercially exploit the Books, Ebooks and Audiobooks in any way.
§ 6 Lead time
1. The Online Shop will https://gralik.pl process the order within 2 (two) working days, i.e. the days of
the week from Monday to Friday, excluding public holidays, during which the order will be shipped.
The above information is an approximate time counted from the moment of accepting the order to
the execution to the moment of sending the subject of the order to the Customer via e-mail or
traditional mail (to the correspondence address).
2. The Online Shop is https://gralik.pl not responsible for extended delivery time or lack of delivery
due to the Customer providing an incorrect e-mail address or correspondence address.
§ 7 Conditions of complaints
1. The Online Shop is https://gralik.pl liable to the Customer if the sold product has a physical or legal
defect (warranty), where the physical defect is the non-conformity of the delivered product with the
contract. The Online Shop is https://gralik.pl liable under the warranty if the physical defect is found
before the lapse of 2 (two) years from the date of delivery of the product to the Customer.
2. Within 14 (fourteen) calendar days, the Online Shop shall respond to the Customer
https://gralik.pl’s complaint and notify him of the manner of further proceedings.
3. In order for the complaint to be considered by the Online Shop, the https://gralik.pl Customer
should deliver the complained product or products together with the proof of purchase of this
product(s) to the Online Shop https://gralik.pl and a description of the complaint.
4. If the complaint is considered in favor of the Customer, the Online https://gralik.pl Shop will
immediately replace the defective product with a defect-free one or remove the defect. This does not
affect the possibility for the Customer to submit a statement on price reduction or withdrawal from
the contract in accordance with the applicable regulations. If it is not possible to replace the product,
remove a defect in the product or reduce the price, the Online Shop will https://gralik.pl refund the
amount due immediately in accordance with the applicable law.
5. A customer purchasing a product for a purpose directly related to his or her professional or
business activity (a Customer who is not a consumer) has the right to file a complaint in accordance
with the applicable law, while the liability of the Online Shop https://gralik.pl under the warranty for
physical defects of the products is limited to the amount paid by the Customer for the purchase of a
given product.

§ 8 Reimbursement of receivables to Clients
1. The Online Shop shall https://gralik.pl refund the amount due immediately, but not later than
within 14 calendar days in the case of: a) cancel the order or part of the order (in which case the
relevant part of the price will be refunded) d) acknowledge the complaint and the inability to
exchange the Book/Books, Ebook(s), Audiobook(s), removal of a defect in the product, or price
reduction.
2. The Online Shop will https://gralik.pl refund the money to the Customer’s bank account (including
the one linked to the Customer’s payment/credit card).
3. To the fullest extent permitted by law, the Online Shop shall https://gralik.pl not be liable for the
lack of reimbursement of the amounts paid or for the delay of the refund, if, despite sending a
request to the Customer to send the Online Shop https://gralik.pl the Customer’s bank account
number to the e-mail address provided by the Customer, the Customer does not send the Online
Shop https://gralik.pl such a bank account number or if the response does not contain data enabling
the Return. The Online Shop is https://gralik.pl not responsible for the lack of reimbursement of the
amounts paid or the delay of the refund, if they are the result of the Customer providing incorrect
address data, personal data or incorrect bank account number.
§ 9 Withdrawal from the agreement.
1. Customers have the right to withdraw from the purchase agreement.
2. In the event of withdrawal from the contract, the buyer shall be refunded for the purchased books
in paper within 7 days to the account indicated by the buyer.
3. Upon withdrawal from the purchase agreement, the customer is obliged to send the purchased
paper book or books to the address of Ireneusz Gralik, i.e. Kąty Grodziskie 19 c/46, 03-289 Warsaw.
4. If you purchase a book in the form of an ebook, it is not possible to withdraw from the contract.
§ 10 Personal data
1. The Customer consents to the processing by the Online Shop of https://gralik.pl personal data
provided by him in the process of placing an order in the Online Shop https://gralik.pl. The provision
of personal data by the Customer is voluntary, however, there is no consent to the processing of
https://gralik.pl personal data by the Online Shop may prevent the Online Shop from providing
https://gralik.pl services electronically and from making purchases in the Online Shop
https://gralik.pl.
2. Personal data is processed by the company, i.e. Ireneusz Gralik with its registered office in Warsaw
03-289, Kąty Grodziskie 19 C/46.
3. The Online Shop https://gralik.pl processes personal data in order to provide services electronically,
conclude and perform sales contracts with the Customer for products ordered by the Customer in the
Online Shop https://gralik.pl
4. You have the right to access, correct and delete your personal data.
5. The Client declares that the personal data provided by the Client are the Client’s data.
§ 11 Final provisions
1. Information about Books, Ebooks and Audiobooks posted on the pages of the https://gralik.pl
Online Shop does not constitute an offer within the meaning of the Civil Code.
2. The https://gralik.pl Online Shop makes every effort to ensure that the services provided within the
Online Shop are https://gralik.pl at the highest level, however, the https://gralik.pl Online Shop does
not exclude the possibility of temporarily suspending availability in the event of the need for
maintenance, inspection, replacement of equipment or in connection with the need to modernize or
expand the Online Shop https://gralik.pl.
3. To the fullest extent permitted by law, the https://gralik.pl Online Store shall not be liable for
blocking the sending of messages to the e-mail address indicated by the Customer by mail server
administrators and for deleting and blocking e-mails by the soware installed on the computer used
by the Customer.
4. In matters not regulated herein, the provisions of Polish law, in particular the Civil Code and the
provisions of the Act of 30 May 2014 on Consumer Rights (consolidated text of 24 June 2014, Journal
of Laws of 2014, item 827) shall apply.
5. Any disputes arising between a Customer who is not a consumer within the meaning of the
provisions of the Civil Code and the Online Shop shall https://gralik.pl be resolved by the court having
jurisdiction over the registered office of the Online Shop https://gralik.pl.
6. The Online Shop https://gralik.pl reserves the right to change the Terms and Conditions for
important technical, legal and/or organizational reasons. The amendment to the Terms and
Conditions shall become effective on the date indicated by the Online Shop https://gralik.pl, not less
than 7 days from the moment of making the https://gralik.pl amended terms and conditions available
on the Online Shop website. Orders placed by Customers before the amendments to the Terms and
Conditions come into force are processed in accordance with the existing provisions of the Terms and
Conditions.
